By visiting our website, using any part of the Services and/or purchasing products from us, you agree to be bound by these Terms, including any additional terms, conditions and policies referenced herein or available by hyperlink.

These Terms apply to all users of the website, including without limitation browsers, customers and contributors of content.

Any new products, features or tools added to the current store will also be subject to these Terms.

Our store is hosted by Shopify Inc., which provides the online e-commerce platform that enables us to sell our products and Services to you.

Product Descriptions and Photography

We make reasonable efforts to describe and photograph our products accurately.

However, the appearance of colors may vary because of photography, lighting, editing, monitor settings, mobile-device displays and other factors outside our control. We cannot guarantee that your device will display every color exactly as it appears in person.

Measurements provided on the website are approximate unless expressly stated otherwise.

Natural, Handmade and Artisanal Variations

Many Bibi & Belle products are made from or incorporate natural materials, handwoven elements, handcrafted details, artisanal finishes or individually sourced components.

Accordingly, reasonable variations may occur in characteristics including:

color;
texture;
weave;
grain;
pattern placement;
shape;
dimensions;
finish; and
other characteristics inherent to natural or handmade materials.

These variations contribute to the individual character of the merchandise and are not considered defects solely because an item varies from photographs, samples or another item of the same type.

Nothing in this provision limits rights relating to merchandise that is actually defective or materially inconsistent with its description under applicable law.

Styled Photography

Bibi & Belle products and tablescape sets may be photographed with additional tableware, furniture, linens, florals, food, candles, decorative objects and other styling elements for illustrative and inspirational purposes.

Only the products and quantities expressly identified as included in the applicable product description or “What’s Included” section are included with your purchase.

Unless specifically identified as included, any plates, glassware, flatware, flowers, food, furniture, candles or other decorative or styling elements appearing in photographs are not included.

You are responsible for reviewing the complete product description and “What’s Included” section before purchasing.

SECTION 6 — PRODUCT AVAILABILITY AND SOURCING

All products are subject to availability.

Because certain Bibi & Belle tablescapes contain curated or individually sourced components, availability of particular pieces may change.

We reserve the right to discontinue products or collections at any time.

If, after you place an order, we determine that an item required to fulfill your order is unavailable, we may cancel the affected item or order and refund the amount paid for the merchandise we are unable to fulfill.

We are not required to substitute another item without your consent.

SECTION 7 — ORDERS, BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse or cancel an order, subject to applicable law.

We may limit or cancel quantities purchased per person, household, account, payment method, billing address or shipping address.

We may limit or prohibit orders that, in our reasonable judgment, appear to be fraudulent, unauthorized, placed for resale or otherwise inconsistent with these Terms.

If we cancel merchandise after payment has been collected, we will refund the applicable amount.

You agree to provide current, complete and accurate purchase, billing, shipping and account information.

You represent that you are authorized to use any payment method submitted in connection with an order.

Available payment methods are displayed at checkout and may be processed by Shopify or other third-party payment providers.

SECTION 8 — NO ORDER CHANGES OR CANCELLATIONS

ORDERS CANNOT ORDINARILY BE CHANGED OR CANCELED ONCE THEY HAVE BEEN PLACED.

Please review your selections, quantities, shipping address, billing information and all other order details carefully before completing your purchase.

SECTION 9 — FINAL SALE; RETURNS AND EXCHANGES

ALL SALES ARE FINAL. WE DO NOT ACCEPT RETURNS OR EXCHANGES.

Please carefully review product descriptions, photographs, dimensions, quantities, materials, colors, care information and included items before completing your purchase.

Our Shipping & Returns Policy is incorporated into these Terms by reference.

Damaged, Defective or Incorrect Merchandise

Our final-sale policy does not prevent you from contacting us regarding merchandise that arrives damaged, is materially defective or is different from the merchandise ordered.

If you believe you received damaged, defective or incorrect merchandise, please contact us promptly at main@bibiandbelle.com and provide:

your order number;
a description of the issue;
clear photographs of the merchandise; and
photographs of the shipping box and packaging, where relevant.

Please retain the affected merchandise and all original packaging while we review the matter.

We will review the circumstances and provide the appropriate remedy, if any.

SECTION 10 — SHIPPING AND DELIVERY

Orders are typically prepared for shipment within 3–5 business days.

Because Bibi & Belle tablescapes are carefully curated and may include pieces sourced from multiple locations, select orders may require up to 7 business days to process.

Business days do not include weekends or holidays.

Processing time refers to the period before merchandise is physically transferred to the shipping carrier.

Carrier transit times begin once merchandise has been shipped and vary depending on destination and shipping service.

Any estimated delivery date or carrier transit time is an estimate rather than a guarantee unless expressly stated otherwise.

Delivery may be affected by carrier disruptions, severe weather, transportation interruptions, holidays or other circumstances outside our reasonable control.

Shipping Information

You are responsible for providing a complete and accurate shipping address at checkout.

Please review your shipping information carefully before completing your order.

Because orders cannot ordinarily be modified after placement, we cannot guarantee that a shipping address can be changed after an order has been submitted or entered processing.

We are not responsible for delays directly caused by inaccurate or incomplete information supplied by the customer.

Tracking and Delivery Issues

Tracking information will be provided when available after shipment.

Tracking information and delivery scans are supplied by third-party carriers.

If tracking indicates that an order has been delivered but you cannot locate it, please contact the applicable carrier and Bibi & Belle promptly so the circumstances can be reviewed.

SECTION 11 — PRODUCT USE, CARE AND SAFETY

You are responsible for using products only for their intended purpose and in accordance with all product descriptions, care instructions, warnings and safety information provided on our website, packaging or accompanying materials.

Unless expressly stated otherwise, Bibi & Belle products are intended for ordinary household decorative or tabletop use.

Decorative Items and Food Contact

Unless an individual product description expressly states that an item is suitable for direct food or beverage contact, you should not assume that a decorative item is food safe.

Do not assume that an item is dishwasher safe, microwave safe, oven safe or suitable for any particular food-service use unless expressly stated.

Candles, Candleholders and Open Flame

Any use of candles, candleholders or other products around an open flame requires appropriate care.

Never leave a burning candle unattended.

Keep candles and open flames away from children, pets, drafts, flammable materials and combustible surfaces.

Use candles only on stable, appropriate surfaces and follow all safety instructions supplied with the candle, candleholder or related product.

Do not use a candleholder or similar item if it is cracked, damaged or otherwise appears unsafe.

You are responsible for selecting and using candles that are appropriate for the applicable holder.

Children and Pets

Unless expressly marketed for use by children, decorative products are not toys.

Exercise appropriate care when displaying breakable items, small decorative objects, candles or other products in areas accessible to children or pets.

Product Care

Care requirements vary by material and product.

You are responsible for reviewing and following all applicable care instructions.

To the fullest extent permitted by law, damage caused by misuse, improper cleaning, improper storage, failure to follow care instructions or use inconsistent with a product's intended purpose is not considered a product defect.

SECTION 12 — THIRD-PARTY PRODUCTS AND BRANDS

Certain curated sets or products offered by Bibi & Belle may contain merchandise manufactured or branded by third parties.

Third-party trademarks, trade names and product names remain the property of their respective owners.

Unless expressly stated, the inclusion or resale of third-party merchandise does not imply sponsorship, endorsement, partnership or affiliation between Bibi & Belle and the applicable third-party brand.

Manufacturer warranties, if any, may be subject to the manufacturer's separate terms.

Nothing in this section eliminates any obligation Bibi & Belle has to you under applicable law.

SECTION 13 — OPTIONAL TOOLS

We may provide access to third-party tools or services over which we do not monitor or exercise direct control.

Such tools may be provided subject to separate terms and privacy practices maintained by the applicable third-party provider.

To the fullest extent permitted by law, we are not responsible for the independent operation, availability or practices of third-party tools we do not control.

Any future features or Services offered through the website will also be subject to these Terms where applicable.

Certain content or Services may include links to websites operated by third parties.

Third-party websites are independent from Bibi & Belle, and we are not responsible for examining or evaluating their content, accuracy, availability, security, products, services or practices.

To the fullest extent permitted by law, Bibi & Belle is not responsible for loss or damage arising from your independent transactions or interactions with third-party websites or services.

Please review the applicable third party's terms and policies before entering into a transaction.

If you submit a review, comment, suggestion, photograph, feedback or other content to us, you represent that you have the right to submit that material and that it does not violate any third-party rights.

Your submissions may not contain unlawful, defamatory, fraudulent, obscene, infringing or malicious material or harmful code.

We reserve the right, but not the obligation, to monitor, decline to publish or remove content that violates these Terms or applicable law.

You are responsible for the content and accuracy of submissions you provide.

Your submission and our processing of personal information through the store are governed by our Privacy Policy, which is incorporated into these Terms by reference.

If we cancel an order after collecting payment because of such an error, we will refund the applicable amount.

The website and its content, including without limitation the Bibi & Belle name, logos, trademarks, trade dress, photographs, videos, graphics, illustrations, original product descriptions, written content, website design and other original materials, are owned by or licensed to Bibi and Belle LLC and are protected by applicable intellectual-property laws.

Access to our website does not transfer ownership of or grant you a license to commercially use our intellectual property.

Except as permitted by law, you may not without our prior written permission:

reproduce or republish our photographs;
copy substantial portions of our original written content;
use our photographs to advertise or sell merchandise;
commercially distribute our website content;
modify or create unauthorized derivative works from protected content;
systematically scrape or extract protected website content; or
use Bibi & Belle branding in a manner likely to create confusion concerning affiliation, sponsorship or endorsement.

SECTION 20 — DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR ANY EXPRESS WARRANTY WE PROVIDE OR ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED, THE WEBSITE, SERVICES AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that access to the website will always be uninterrupted, timely, secure or error-free.

We do not warrant that every website error will immediately be corrected.

Nothing in these Terms excludes, limits or disclaims a warranty, consumer right or remedy that applicable law does not permit us to exclude, limit or disclaim.

Shopify's original Terms contain a similarly broad warranty disclaimer. I kept the concept but added the “to the fullest extent permitted by applicable law” qualification. New York law specifically requires a written disclaimer of merchantability to mention merchantability and be conspicuous, which is why this section is written prominently.

SECTION 21 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIBI AND BELLE LLC AND ITS MEMBERS, MANAGERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, SUPPLIERS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE, SERVICES OR PRODUCTS, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA OR SIMILAR LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF BIBI AND BELLE LLC ARISING OUT OF OR RELATING TO A PARTICULAR PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO BIBI AND BELLE LLC FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations apply regardless of whether a claim is based in contract, tort, negligence, strict liability or another legal theory, but only to the extent such liability may lawfully be limited.

Nothing in these Terms limits or excludes liability for any matter for which liability cannot legally be excluded or limited.

SECTION 22 — ASSUMPTION OF RESPONSIBILITY FOR PRODUCT USE

You are responsible for selecting products appropriate for your intended use and for using products safely and in accordance with their descriptions, instructions and warnings.

To the fullest extent permitted by law, Bibi & Belle is not responsible for injury, property damage or other loss caused solely by:

misuse of a product;
use contrary to supplied instructions or warnings;
modification or alteration of a product after purchase;
failure to exercise reasonable care around flames or heat;
use of a decorative item for food contact when it was not represented as food safe; or
continued use of merchandise after it becomes visibly damaged or unsafe.

Nothing in this section limits liability that cannot lawfully be excluded.

SECTION 23 — INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless Bibi and Belle LLC, together with its affiliates, members, managers, officers, directors, employees, agents, contractors, licensors, suppliers and service providers, from third-party claims, liabilities, damages, losses and reasonable attorneys' fees arising from:

your material breach of these Terms;
your unlawful or unauthorized use of the Services;
your misuse of our products;
your violation of applicable law; or
your infringement or violation of another person's rights.

This preserves the indemnification protection contained in Shopify's original Terms.

SECTION 24 — FORCE MAJEURE

To the fullest extent permitted by law, Bibi & Belle will not be liable for delay or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fires, floods, governmental actions, labor disruptions, carrier interruptions, transportation failures, power or communications outages, supply-chain disruptions or similar events.

This provision does not eliminate any cancellation, refund or other remedy that applicable law requires us to provide.

SECTION 25 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 26 — TERMINATION

These Terms remain effective unless and until terminated.

You may terminate your use of the Services by ceasing to use our website.

We may suspend or terminate access to the Services where we reasonably believe you have materially violated these Terms, subject to applicable law.

Obligations and liabilities incurred before termination and provisions that by their nature are intended to survive termination will continue after termination.

SECTION 27 — ENTIRE AGREEMENT; NO WAIVER

These Terms, together with our Privacy Policy, Shipping & Returns Policy, and other policies expressly incorporated by reference, constitute the agreement between you and Bibi & Belle regarding use of the Services and purchases through the website.

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

If these Terms conflict with a consumer right that cannot lawfully be waived, applicable law will control to the extent of that conflict.

SECTION 28 — INFORMAL DISPUTE RESOLUTION

Before initiating formal legal proceedings relating to these Terms, the website or a purchase from Bibi & Belle, we encourage you to contact us at main@bibiandbelle.com with a description of the issue so that we may attempt to resolve the matter.

To the extent permitted by applicable law, the parties agree to make a good-faith effort to resolve a dispute informally before commencing formal litigation.

Nothing in this section prevents either party from seeking urgent injunctive relief or exercising a right that cannot lawfully be restricted.

SECTION 29 — GOVERNING LAW

These Terms and any separate agreements through which we provide Services will be governed by and construed in accordance with the laws of the State of New York and applicable federal law, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

SECTION 30 — CHANGES TO THESE TERMS

We reserve the right to update, change or replace these Terms by posting a revised version on this page.

The effective date at the beginning of these Terms identifies the current version.

Changes will apply prospectively to the extent required by applicable law.
